This country report for Belgium prepared in the frame of the POSTING.STAT 2.0 project, examines the characteristics, the scale, and the impact of intra-EU posting from and to Belgium as well as the characteristics and the scale of infringements which are related to it.

The Belgian Council of Ministers has approved a draft bill aimed at strengthening rules on labour migration and improving the framework for highly qualified non-EU workers. The proposal includes measures aimed at strengthening the fight against fraud linked to labour migration, while also seeking to make the European Blue Card more attractive for highly qualified workers from outside the European Union. The draft bill also provides for additional protection for workers who are victims of certain social law infringements committed by employers. The text will now be submitted to the Council of State for advice.

During the Justice and Home Affairs Council on 13 December 2024, Member States agreed on a proposal aimed at bringing their criminal law closer together on issues such as the definition and sanctioning of migrant smuggling. The text will now be used by the Council in “trilogue” negotiations with the European Parliament.

On 1 October 2014, the European Commission has released its 31st Annual Report on monitoring the application of EU law in Member States. As far as home affairs and migration issues are concerned, four infringement procedures are open against Belgium.
