Op 3 juni 2025 heeft het Hof van Justitie van de Europese Unie (HvJ-EU) een uitspraak gedaan die de reikwijdte van het strafbaar feit van het faciliteren van illegale binnenkomst in de EU verduidelijkt. Het Hof oordeelde dat een onderdaan van een derde land niet strafrechtelijk mag worden vervolgd voor het binnenbrengen van minderjarigen onder zijn of haar hoede in een EU-lidstaat, ook al is deze binnenkomst in strijd met de grensregels. Deze beslissing benadrukt de bescherming van gezinsverantwoordelijkheden en fundamentele rechten binnen het EU-recht.

Op 21 en 22 mei 2025 organiseerde de Return Expert Group van het Europees Migratienetwerk (EMN REG), in samenwerking met de Dienst Vreemdelingenzaken en EMN België, een tweedaagse workshop die 50 experten van EU-lidstaten, EU-agentschappen (waaronder Frontex en de EUAA), maatschappelijke organisaties en internationale organisaties samenbracht. Het evenement richtte zich op de ontwikkeling en implementatie van effectieve alternatieven voor detentie (ATD’s) binnen het migratie- en terugkeerbeleid van de EU.

The European Commission has released new figures revealing a substantial rise in short-stay visa applications to the EU and Schengen-associated countries in 2024. With over 11.7 million applications submitted, the upward trend reflects a continued post-pandemic recovery, although numbers remain below pre-COVID levels. Notably, Bulgaria and Romania began issuing Schengen visas on 31 March 2024, further integrating into the Schengen visa system.

On 13 May 2025, Belgian authorities arrested six individuals in West Flanders as part of a coordinated international operation targeting an organised migrant smuggling network suspected of facilitating the irregular entry of up to 300 non-EU nationals into the European Union. In total, fifteen suspects were apprehended in Belgium, Germany and Poland, in a series of actions supported by Europol and Eurojust and involving close cooperation between law enforcement and judicial authorities in the participating countries.

On 7 May 2025, the Court of First Instance of West Flanders, Bruges division, sentenced the Vietnamese national, N. Van Kim (34), in absentia to twelve years’ imprisonment and a fine of €616,000 for human smuggling under aggravating circumstances. The court also ordered the deprivation of his civil rights for ten years and issued a warrant for his immediate arrest.

EU Home Affairs Ministers approved a roadmap for the gradual implementation of the Entry/Exit System (EES) starting in October 2025, the revised Eurodac database set to become operational in June 2026 and ETIAS in late 2026. Ministers also reached broad agreement on facilitating go-and-see visits for Syrians in the EU to assess conditions in their home country without losing their protection status, as well as on measures to return Syrian nationals who pose a security threat or have been convicted of crimes.

In a coordinated effort to combat human trafficking, Europol hosted an international operational action from 25 to 28 February 2025, bringing together experts in analysis, OSINT (Open Source Intelligence), and investigations from 12 countries, including Belgium. The operation focused on detecting and disrupting human trafficking networks operating online, particularly those exploiting Ukrainian nationals.

The province's share of interceptions also went up. West Flanders accounted for about 70% of all transit migrants intercepted in Belgium in 2024, compared to around 50% in previous years.

From 9 December 2024 until 8 June 2025, the Royal Netherlands Marechaussee will conduct temporary checks at its borders with Belgium and Germany to, among other things, stem irregular immigration into the country and combat migrant smuggling. Travellers intending to cross the border are advised to carry their ID documents with them.
