This ad hoc query maps the legislative frameworks and practices regarding the issuance of residence and work permits to third-country national cargo transport drivers, detailing posting conditions, specific sectoral requirements, and compliance challenges across EMN Member Countries. 

Carriers transporting third-country nationals by air, sea, or land to the Schengen area are required to take all necessary measures to ensure that these individuals hold the travel documents needed for entry into the Schengen States. The European Commission has launched three ad hoc queries, each focusing on a specific aspect of carriers’ liability: the framework of sanctions and penalties; responsibility for costs; and cooperation with carriers and control/supervision.

On 21 and 22 May 2025, the European Migration Network’s Return Experts Group (EMN REG) convened a two-day workshop, hosted by the Belgian Immigration Office and EMN Belgium. The event brought together 50 participants from EU Member States, EU agencies (including Frontex and the EU Asylum Agency), civil society organisations, and international organisations. The workshop focused on the development and implementation of effective alternatives to detention (ATDs) within the EU’s migration and return systems.
