De Belgische Raad van State heeft de beslissing van de minister van Asiel en Migratie geschorst om de materiële opvangvoorzieningen te beperken voor verzoekers om internationale bescherming die reeds bescherming hebben verkregen in een andere EU-lidstaat. In arrest nr. 267.364 van 8 juli 2026 schorste de Raad van State de maatregel na een vordering tot schorsing bij uiterst dringende noodzakelijkheid, ingesteld door verschillende organisaties die actief zijn op het gebied van asiel en migratie. De beslissing heeft betrekking op een maatregel die werd genomen naar aanleiding van het van toepassing worden van het Europees Migratie- en Asielpact op 12 juni 2026.

The European Commission has rejected calls from the aviation sector and the Port of Dover to suspend the EU Entry/Exit System (EES) during the summer travel season. While acknowledging operational difficulties at around 20 external border crossing points, the Commission considers that suspending the system would not be appropriate. The Belgian Council of State has suspended a ministerial instruction that systematically limited material assistance to international protection applicants who had already obtained protection in another EU Member State. The court ruled that the instruction exposed these individuals to the risk of severe hardship and potential homelessness. It also noted that, due to its regulatory character, the instruction should have been submitted for review by the Council of State’s Legislation Section.

The Belgian Constitutional Court has temporarily suspended legislative measures introduced in 2025 that tightened rules on material reception conditions for asylum seekers and family reunification for beneficiaries of subsidiary protection. The suspensions concern two separate laws, and the Court has referred several preliminary questions to the Court of Justice of the European Union (CJEU) to clarify their compatibility with EU law.

The Office of the Commissioner General for Refugees and Stateless Persons (CGVS) announced on 15 January 2026 that it is temporarily suspending the processing of applications for international protection from Iranian nationals. The CGVS stated that, given the current situation in Iran and the difficulty in obtaining sufficiently reliable and up-to-date information, it is currently unable to assess the need for protection accurately.
