The lived experiences of migrants in the EU with a single permit (ULB)

New research carried out in the context of the Equality Law Clinic at the Université Libre de Bruxelles (ULB) focuses on the EU Single Permit Directive and shares concerns regarding the complexity and efficiency of the application (and renewal) procedure, the exclusion of certain categories of migrants from the scope of the Directive and the lack of protection of migrant workers from exploitation.

Economic migration is on the rise in Belgium, according to Myria

Myria has published the fourth thematic section of its 2023 annual report. This section entitled "Economic migration, free movement en students" reports that 8.098 long-stay visas were granted for professional reasons to third-country nationals in 2022 (46% more than in 2021) and 19.721 single permits were issued to third-country nationals in 2022 (75% more than in 2021).

The Belgian Red Cross-Flanders is looking for volunteers to help refugees searching for missing relatives

During the first six months of 2023, the Belgian Red Cross-Flanders already helped 152 people – mostly refugees – in their search for lost relatives. That is the highest number since 2017. The organisation is looking for volunteers who want to commit at least 6 hours a week to help find the missing relatives.

Ad Hoc Query on seasonal workers directive

EMN Luxembourg launched an ad hoc query on the implementation of the Seasonal Workers Directive. More specifically, the questions focus on the possible requirement for seasonal workers to undergo a medical examination upon or before entry into the country, as well as on the national implementation of the right to equal treatment, as enshrined in Article 23(1) of said Directive.

The Court of Justice released its judgment in Case C-1/23 PPU | Afrin with a significant impact on applications for family reunification

Ad Hoc Query on the possibility of concluding a marriage between a European citizen and a third-country national who resides illegally on the territory

In the Czech Republic, a marriage can, under the current legislation, only take place if both parties have legal residence on the territory. By launching this ad hoc query, the Czech National Contact Point (NCP) to the European Migration Network (EMN) wanted to know more about the existing practices in other Member Countries.

State Secretary for Asylum and Migration states that single permits which have been improperly issued will be withdrawn

In the House of Representatives today, Nicole de Moor responded to numerous questions regarding possible fraudulent cases of applications for single permits. All involved actors, including the Flemish Region, the Federal Public Service Foreign Affairs and the Immigration Office, are now part of a working group to foster information exchange and avoid future abuses.

New AIDA report concludes that various improvements are needed to ensure the effectiveness of the right to family unity of persons in need of protection

Conference on Piloting skills mobility: Lessons learned from the MATCH project and the way forward

The CJEU rules that unaccompanied minors don't have to be unmarried to be sponsors for their parents in family reunification procedures.

The Court of Justice of the European Union interpreted Article 2(f) and Article 10(3)(a) of the Family Reunification Directive in its decision from 17 November 2022 in the case X v Belgium. An unaccompanied refugee minor residing in a Member State does not have to be unmarried to enjoy the right to family reunification with first-degree relatives in direct ascending line.

Ad Hoc Query on the recognition of diploma's from third countries

How do other EU Member States, and Georgia, recognise diplomas obtained in third countries? This ad hoc query, that Belgium launched in July 2022, focused on the (i) institutional landscape for diploma recognition throughout Europe, (ii) the role of Public Employment Services in this recognition and (iii) best practices that the responding States wanted to share regarding their diploma recognition practices, specifically in the context of the Ukrainian crisis. 20 countries answered the query.

Attracting and protecting the rights of seasonal workers (EMN)

For many EU countries, seasonal workers from third countries are crucial to fill temporary, cyclical labour market needs. Since the adoption of the Seasonal Workers Directive in 2016, this specific category of workers can benefit from EU-harmonised admission policies and rights concerning their entry and stay.
