Ad Hoc Query on access to the labour market for family members of international students

Do Member States grant access to the labour market to family members of international students and, if so, to which family members and under which conditions? This ad hoc query launched by Belgium shows that policies and practices in this matter still vary among Member States.

The responses to the AHQ inter alia show that:

  • Twelve responding States grant family members of international students access to the labour market. In Lithuania however, only the family members of doctoral students and M.A. students are entitled to family reunification and to access the labour market. In France, access to work for family members is only possible in the framework of family reunification but students can apply for family reunification only after 18 months of stay, and they find it difficult to meet the conditions, particularly the resource criteria. 
     
  • Generally the family members of international students who can access the labour market are those who are entitled to family reunification and who have the minimum age requirements to carry out work activities.
     
  • In some States the family members of international students are free to access the labour market without additional requirements. In Finland for example, a person can start working once a residence permit has been granted. In other States, access to the labour market may be subject to additional conditions. For example in Austria, the family members of international students must obtain a work permit. In Hungary family members issued with a residence permit for the purpose of family reunification can be entitled to undertake employment only if they receive a residence permit on the basis of a single application procedure. 
     
  • Once access to the labour market is granted to family members of international students, there is no limitations in terms of working hours etc. In Germany, while the access to the labour market is limited in terms of working hours for the students themselves, it is not limited for their family members.
