Cette question ad hoc fournit des informations comparatives sur la période d'attente que les demandeurs doivent respecter avant de demander le regroupement familial dans les pays membres et observateurs du REM. Elle examine également les délais légaux de traitement d'une demande de regroupement familial et précise si ce délai de traitement est inclus dans le délai d'attente susmentionné.

Cette conférence organisée par le REM Pays-Bas, en coopération avec le REM Belgique, se concentrera sur le regroupement familial des bénéficiaires d'une protection internationale dans les pays membres et observateurs du REM. L'influence de la jurisprudence européenne dans ce domaine sera également examinée plus en détail.

La Cour de justice de l’Union européenne a interprété l’article 2(f) et l’article 10(3)(a) de la directive sur le regroupement familial dans sa décision du 17 novembre 2022 dans l’affaire X contre la Belgique. Un réfugié mineur non-accompagné résidant dans un État membre n’a pas besoin d’être "non-marié" pour bénéficier du droit au regroupement familial avec des membres de sa famille au premier degré en ascendance directe.

In a judgment handed down today, the EU Court of Justice responded to a Dutch prejudicial question on family reunification of (unaccompanied minor) refugees. Following the reasoning of the Court, an unaccompanied minor who attains the age of majority during the asylum procedure retains its right to family reunification.
