Due to the increased need for foreign labour force, Member States are multiplying their negotiations of bilateral agreements and programmes with third countries on labour mobility. In order to have a current state of play and with a view to better coordinate this matter, the European Commission asked EMN Member countries to provide information on any bilateral agreement or programme supporting mobility from third countries.

EMN Luxembourg launched an ad hoc query on the implementation of the Seasonal Workers Directive. More specifically, the questions focus on the possible requirement for seasonal workers to undergo a medical examination upon or before entry into the country, as well as on the national implementation of the right to equal treatment, as enshrined in Article 23(1) of said Directive.

EMN Slovakia launched a series of questions regarding the implementation of the revised Blue Card Directive and, more specifically, the implementation of Article 13 of said Directive regarding recognition procedures for employers.

The Belgian authorities are looking to improve/review the special residence procedure for unaccompanied foreign minors, known as the Best Interest Procedure. In this context, Belgium launched three ad hoc queries to seek information from other Member States on (i) similar residence procedures specifically for UAMs, (ii) procedures followed in case return to the country of origin is considered and (iii) steps taken to implement return decisions.

EMN Sweden launched an ad hoc query regarding the derived right of residence of a third-country national family member under Article 20 of the Treaty on the Functioning of the EU (TFEU). In the context of the draft law ‘controlling immigration, improving integration’, currently under discussion in the French Parliament, France is reflecting on possible changes to the procedure for issuing a residence permit for care, whether of a legislative or regulatory nature. To examine the legal and operational feasibility of the proposed amendments, EMN France enquired from the Member States about the relevant legal provisions in this matter.

In the event of implicit withdrawal or abandonment of an asylum application, Art. 28 par. 2 of the directive 2013/32/EU allows Member States to determine in their legislation a time limit of at least nine months, after which the applicant’s case can no longer be reopened or the new application may be treated as a subsequent application. The German Federal Office for Migration and Refugees launched an ad hoc query to enquire whether and how the Member States transposed this provision.

At the beginning of 2023, a coordination meeting of the directors of the Belgian closed detention centers was held. At this meeting, they expressed their concern about the significant increase in the trafficking of drugs inside their centers. In response to the large influx of Ukrainian refugees, the Estonian Ministry of Culture is looking into setting up new possibilities for e-learning the local language. The objective of this query is to map other EMN Member and Observer Countries’ experience with technologies such as artificial intelligence, virtual reality, and augmented reality, to develop an offer of virtual language learning.

The Dutch National Contact Point (NCP) to the European Migration Network launched an ad hoc query on the existing data on unaccompanied minors (UAMs) outside of international protection procedures in other Member Countries. With this query, the Dutch NCP wanted to get a better picture of the total influx of UAMs in a European perspective.
