Parliamentary hearing on legislative proposal concerning the prohibition of detention of minors

On 16 September 2020, the Interior Committee of the Belgian House of Representatives held a parliamentary hearing on a legislative proposal concerning the prohibition of detention of minors. EMN Belgium contributed to the hearing by presenting the laws, policies and practices in other EU Member States.

The legislative proposal (DOC 55 0892/001) submitted by various members of the federal parliament set outs a general prohibition to detain minors in migration procedures. The proposal also introduces a presumption of minor age for foreign nationals declaring to be unaccompanied minors during the age assessment process.

The Interior Committee invited EMN Belgium and several other speakers to a parliamentary hearing to provide more information on the detention of minors in the context of migration. In its intervention, EMN Belgium discussed the laws, policies and practices in other EU Member States with regard to:

  • detention and the prohibition of detention of minors;
  • alternatives to detention for families with minors;
  • detention during the age assessment process.

Prior to the hearing in parliament, EMN Belgium launched an urgent Ad-Hoc Query in order to collect the most up-to-date information.
