La Cour de justice de l’Union européenne a interprété l’article 2(f) et l’article 10(3)(a) de la directive sur le regroupement familial dans sa décision du 17 novembre 2022 dans l’affaire X contre la Belgique. Un réfugié mineur non-accompagné résidant dans un État membre n’a pas besoin d’être "non-marié" pour bénéficier du droit au regroupement familial avec des membres de sa famille au premier degré en ascendance directe.

In a judgment handed down today, the EU Court of Justice responded to a Dutch prejudicial question on family reunification of (unaccompanied minor) refugees. Following the reasoning of the Court, an unaccompanied minor who attains the age of majority during the asylum procedure retains its right to family reunification.
