The Court of Justice of the European Union has ruled on the compatibility of a national residence requirement with EU equal treatment rules. The Court examined whether a 10-year residence condition could be applied to beneficiaries of international protection in order to access a social benefit. It found that the measure constitutes indirect discrimination prohibited under EU law.

DUO for a JOB has launched a national awareness campaign highlighting the persistence of discrimination in recruitment processes in Belgium. The initiative uses the format of the well-known game “Guess Who?” to illustrate how candidates may still be excluded on the basis of appearance, name, origin or accent rather than skills. The campaign is being rolled out in May across public spaces, including stations and metro networks in several Belgian cities.

On 6 May, the United Nations Human Rights Council reviewed Belgium under the Universal Periodic Review (UPR), a peer-review mechanism assessing the human rights situation in all UN Member States. The review examined the implementation of previous recommendations and the current situation across a range of policy areas, including asylum, migration and detention.

The Belgian Commissioner General for Refugees and Stateless Persons (CGRS) announces a series of changes that will apply from 12 June 2026. These changes are part of the implementation of the EU Pact on Migration and Asylum, adopted in 2024. They will affect asylum procedures, operational practices and new institutional responsibilities.

Based on data released by the International Organization for Migration (IOM), nearly 7.900 deaths or disappearances were recorded on migration routes worldwide in 2025. This compares with approximately 9.200 recorded in 2024. The figures bring the cumulative total to more than 80.000 deaths or disappearances recorded since 2014, when the Missing Migrants Project began collecting data.

In 2025, minors accounted for 23.7% of all first-time asylum applicants in the European Union, according to recent Eurostat data. A total of 158.400 children applied for asylum for the first time, including a significant proportion of unaccompanied minors. While the overall number of minor applicants declined compared to previous years, children continue to represent a substantial share of asylum seekers in the EU.

The Council for Alien Law Litigation (CALL) has made the use of its child-friendly courtroom (“Salle M”) a structural arrangement as of March 2026. The measure applies to asylum appeal cases involving unaccompanied minors and is accompanied by adapted summonses, age-appropriate information materials, and strengthened judicial training on children’s rights. The initiative builds on a pilot phase and forms part of broader European efforts to enhance child-friendly justice.

On 22 April 2026, the Belgian Federal Ombudsman published its annual report for 2025. The institution recorded a further increase in the number of cases handled, with migration-related issues remaining the main source of complaints. The report highlights recurring concerns linked to administrative procedures, in particular in the field of visas and residence-related decisions.

The Belgian Council of Ministers has approved a draft law aimed at bringing Belgian legislation on the guardianship of unaccompanied minors into line with the EU Pact on Migration and Asylum and introducing additional safeguards for minors. The text has been submitted to the Council of State for its opinion.

Belgium is advancing plans to consolidate its asylum and migration services under a single Federal Public Service (FPS) Migration. The initiative aims to create a unified administrative framework for managing asylum and migration processes. The governance model for the new service was approved by the Council of Ministers to structure its internal organisation.

On 20 March 2026, the Belgian Council of Ministers approved a draft law that would link the level of social assistance granted to beneficiaries of subsidiary and temporary protection to their participation in integration efforts through the Individual Social Integration Project (ISIP). Under the proposal, the amount of social assistance could be adjusted depending on the efforts made by the beneficiary to integrate.

The Council of Ministers approved, at second reading, two draft bills aimed at implementing the European Pact on Migration and Asylum in Belgian law. The texts were adopted with a view to their submission to the Chamber of Representatives of Belgium under an urgent procedure. The first draft bill aims to apply or transpose eight legislative instruments of the Pact into Belgian law, while the second concerns procedures before the Council for Alien Law Litigation.

Myria has released its first comprehensive mapping of quantitative data on minor victims of human trafficking and aggravated forms of smuggling in Belgium. The report aims to provide a clearer statistical basis for understanding the situation of minors at risk, while also highlighting structural gaps in current data collection and sharing practices.

The Antwerp Family Court has annulled the decisions of local civil registry officials that sought to revoke the Belgian nationality of children born in Belgium to Palestinian parents. In five rulings issued on 27 February 2026, the court emphasised that depriving these children of nationality would be contrary to their best interests.

The second International Migration Review Forum (IMRF 2026) provides a global platform for Member States and relevant stakeholders to discuss progress on the implementation of the Global Compact for Safe, Orderly and Regular Migration. The event will include interactive roundtables, a policy debate, plenary meetings, and opportunities for side events showcasing initiatives and good practices.

The medical office run by Médecins du Monde within the Humanitarian Hub in Brussels will cease its activities on 31 March 2026. The closure follows the recent shutdown of the Athena Medical Centre. According to the organisation, this will further reduce access to primary healthcare for vulnerable groups in the capital. Médecins du Monde has warned of likely consequences for emergency services and for people with limited access to care.

The Summer School in Brussels brings together around 100 participants, including students, academics, and professionals from EU Member States and EU institutions, as well as refugee-students supported by the RefYOUgees initiative. It combines a series of courses on EU Migration and Asylum Law with debates on recent policy developments. Participants also attend seminars presenting PhD research projects and discuss complex legal and policy issues. The programme provides opportunities for interaction and networking among students, academics, practitioners, and refugee participants.

Flanders granted around 21.460 work permits to non-EU nationals in 2025, the highest level in recent years. Seasonal work and medium- to high-skilled positions accounted for a large share of the permits. New rules introduced in January 2026 give priority to domestic and EU labour before non-EU recruitment. Stakeholders, including employer organisations and political parties, have expressed differing perspectives on these developments.

The Council of Europe’s Division on Migration and Refugees published a Frequently Asked Questions document on 12 February 2026, explaining how the European Convention on Human Rights (ECHR) applies to migration issues. It clarifies which rights are relevant to non-nationals, how national authorities retain discretion over entry and stay, and the limited circumstances under which the European Court of Human Rights (ECHR) may intervene. The document also provides data on immigration-related cases processed over the past decade.

On 9 February 2026, the Minerva think tank published a report assessing the economic and demographic impacts of current asylum and migration policies in Belgium, while also considering comparative cases in other European countries. It examines how policy choices in this field interact with labour market needs, demographic trends and public finances, and explores potential medium- to long-term effects associated with different policy approaches. The publication contributes to the broader policy debate by presenting available data and modelling selected scenarios.

On 4 February 2026, Human Rights Watch published World Report 2026, its annual review of human rights worldwide. In a chapter on the European Union, the report highlights concerns that EU policies and Member State actions may undermine the rights of migrants, refugees, and asylum seekers. It notes, inter alia, restrictions on access to asylum, measures aimed at increasing removals, and the transfer of responsibility to third countries. The report also draws attention to human rights issues at EU borders and deaths at sea.

On 29 January 2026, the European Commission presented the first European Asylum and Migration Management Strategy, setting out the Union’s objectives on asylum and migration for the next five years. The Strategy identifies three overarching objectives: preventing irregular migration and disrupting smuggling networks; protecting people fleeing conflict and persecution while preventing abuse of the asylum system; and attracting talent to support the EU economy. It also outlines a set of priorities to guide EU action in the coming years.

From 1 January 2026, the Onder1Dak project, which promotes co-housing between private homeowners and recognised refugees in Flanders, has restarted following renewed support from the Flemish Minister for Civic Integration and Integration. The initiative aims to facilitate access to housing while supporting the social and professional integration of recognised refugees.

On 1 January 2026, Cyprus assumes the Presidency of the Council of the European Union for six months. The Presidency’s programme includes the implementation of the EU Pact on Migration and Asylum, the efficiency of asylum and return systems, and cooperation with third countries. International organisations have issued recommendations to the Cyprus Presidency on migration and asylum.
