Ad Hoc Query on access to education and employment for irregularly staying migrants

In response to the growing awareness of the barriers for irregularly staying adult migrants to access higher education, vocational training and employment, the Netherlands sought to map out existing legislation and practices in other EMN Member countries to facilitate this access.

Ad Hoc Query on the workload of employees involved in the examination of asylum applications

This ad hoc query addresses the human resource management strategies in Asylum and Dublin Units in EMN Member Countries. It provides information on the division of the workload between the different institutions involved in the asylum procedure within the EMN Member Countries, on the number of decisions issued as well as on the methodologies in place to ensure a sufficient number of employees to guarantee decision-making.

Ad Hoc Query on family reunification for beneficiaries of international protection

Ad Hoc Query on monitoring the integration of third-country nationals

As set out in many strategy documents at the EU and OECD levels, there is a growing need to compare integration policies across EU Member States in order to facilitate mutual learning and tackle the lack of evidence on the impact of measures. The objective of this ad hoc query is to provide an overview of different approaches used by the EMN Member and Observer Countries that are designed to monitor and evaluate the integration of third-country nationals. The results of this ad hoc query will form the basis of an upcoming Inform.

Ad Hoc Query on the use of real-time speech-translating devices in the asylum process

The Czech Ministry of Interior is currently looking into the possibility of using real-time speech-translating devices during the asylum procedure, especially during the interviews. It launched an ad hoc query to find out if other Member States are using this type of system in the asylum procedure.

Ad Hoc Query on return decisions and entry bans

The Swedish government has established a committee to review aspects of Swedish legislation concerning the return procedures for third-country nationals. The committee's goal is to propose new measures and revisions to existing laws to enhance the effectiveness of the return process. Consequently, they initiated an ad hoc query to gather information about the regulations related to the limited validity period of return decisions and the duration of entry bans.

Ad Hoc Query on granting a residence permit on the basis of a child protection order

In the Netherlands, there is a special policy applicable to third-country national children based on a family supervision order (child protection order) that is imposed by the juvenile court. The Dutch authorities launched this query because they want to know whether it is possible for a minor third-country national who is covered by a similar order to receive a residence permit in other Member States.

The Luxembourg Ombudsman for Children and Youth (OKaJu), together with UNICEF Luxembourg, is carrying out research on the situation of unaccompanied minors (UAMs) in Luxembourg. Ad Hoc Query on existing bilateral agreements and programmes/projects on legal migration between Member States and third countries

Due to the increased need for foreign labour force, Member States are multiplying their negotiations of bilateral agreements and programmes with third countries on labour mobility. In order to have a current state of play and with a view to better coordinate this matter, the European Commission asked EMN Member countries to provide information on any bilateral agreement or programme supporting mobility from third countries.

Ad Hoc Query on seasonal workers directive

EMN Luxembourg launched an ad hoc query on the implementation of the Seasonal Workers Directive. More specifically, the questions focus on the possible requirement for seasonal workers to undergo a medical examination upon or before entry into the country, as well as on the national implementation of the right to equal treatment, as enshrined in Article 23(1) of said Directive.

Ad Hoc Queries on residence procedure specifically for unaccompanied minors

The Belgian authorities are looking to improve/review the special residence procedure for unaccompanied foreign minors, known as the Best Interest Procedure. In this context, Belgium launched three ad hoc queries to seek information from other Member States on (i) similar residence procedures specifically for UAMs, (ii) procedures followed in case return to the country of origin is considered and (iii) steps taken to implement return decisions.

Ad Hoc Query on derived right of residence under Article 20 of the TFEU

EMN Sweden launched an ad hoc query regarding the derived right of residence of a third-country national family member under Article 20 of the Treaty on the Functioning of the EU (TFEU). These questions were launched in the context of the Swedish Migration Agency’s analysis of the judgment of the CJEU in joined cases C-451/19 and C-532/19 (XU and QP).

Ad Hoc Query on procedure for the issuance of residence permits for medical reasons

In the context of the draft law ‘controlling immigration, improving integration’, currently under discussion in the French Parliament, France is reflecting on possible changes to the procedure for issuing a residence permit for care, whether of a legislative or regulatory nature. To examine the legal and operational feasibility of the proposed amendments, EMN France enquired from the Member States about the relevant legal provisions in this matter.

Ad Hoc Query on time limit to reopen an application in the event of implicit withdrawal or abandonment of the application according to the directive 2013/32/EU

In the event of implicit withdrawal or abandonment of an asylum application, Art. 28 par. 2 of the directive 2013/32/EU allows Member States to determine in their legislation a time limit of at least nine months, after which the applicant’s case can no longer be reopened or the new application may be treated as a subsequent application. The German Federal Office for Migration and Refugees launched an ad hoc query to enquire whether and how the Member States transposed this provision.

Ad Hoc Query on drugs in detention centres

At the beginning of 2023, a coordination meeting of the directors of the Belgian closed detention centers was held. At this meeting, they expressed their concern about the significant increase in the trafficking of drugs inside their centers. That’s why EMN Belgium was asked to launch an ad hoc query in order to gather information on how this issue is addressed in the other Member States.

Ad Hoc Query on innovation in language learning

In response to the large influx of Ukrainian refugees, the Estonian Ministry of Culture is looking into setting up new possibilities for e-learning the local language. The objective of this query is to map other EMN Member and Observer Countries’ experience with technologies such as artificial intelligence, virtual reality, and augmented reality, to develop an offer of virtual language learning.

Ad Hoc Query on data on unaccompanied minors outside of international protection procedures
