In the context of the draft law ‘controlling immigration, improving integration’, currently under discussion in the French Parliament, France is reflecting on possible changes to the procedure for issuing a residence permit for care, whether of a legislative or regulatory nature. To examine the legal and operational feasibility of the proposed amendments, EMN France enquired from the Member States about the relevant legal provisions in this matter.

In the event of implicit withdrawal or abandonment of an asylum application, Art. 28 par. 2 of the directive 2013/32/EU allows Member States to determine in their legislation a time limit of at least nine months, after which the applicant’s case can no longer be reopened or the new application may be treated as a subsequent application. The German Federal Office for Migration and Refugees launched an ad hoc query to enquire whether and how the Member States transposed this provision.

The Dutch National Contact Point (NCP) to the European Migration Network launched an ad hoc query on the existing data on unaccompanied minors (UAMs) outside of international protection procedures in other Member Countries. With this query, the Dutch NCP wanted to get a better picture of the total influx of UAMs in a European perspective.

According to the United Nations High Commissioner for Refugees (UNHCR), as of 15 November 2022, more than 7.8 million people have left Ukraine in search of safety, arriving primarily in neighbouring European Union (EU) and third countries.
