International students: new conditions for extending and ending their stay in Belgium

The Royal Decree of 23 April 2018 introduced changes with regards to extending or ending the stay of international students. It details – inter alia – in which cases an order to leave the territory can be issued to a student when he/she extends his/her studies in an excessive manner considering the results.

The Royal Decree of 23 April 2018 – which entered into force on 27 May 2018 - introduces changes with regards to extending or ending the stay of third-country national students.

The Royal Decree introduces some changes to the procedure to extend the stay of a student, including the time limit to apply for an extension of the temporary residence permit (15 days before the expiration date of the previous residence permit, instead of 1 month) or the documents to be provided when applying for this extension (including a standard document to be filled out by the educational institution).

Furthermore, the Royal Decree details in which cases an order to leave the territory can be issued to a student when he/she extends his/her studies in an excessive manner considering the results. It takes into account the current more flexible education system foreseen by the different Communities, as well as the bachelor/master structure and the system of credits (ECTS).

Transitional measures apply in some cases.
