The Secretary of State for Asylum and Migration announced today that a new software was in the process of being developed with the digital product studio "In the pocket" to better manage information relating to the stay of third-country nationals in closed centres.

In 2023, 875 prisoners staying illegally in Belgium were returned directly from prison

During a visit to the prison in Beveren, the Secretary of State for Asylum and Migration said that more illegally staying detainees are being sent back directly from prisons, through the work of the return counsellors in the detention facilities.

While a draft law introducing a new right of residence for stateless persons is currently being discussed in Parliament, ENS and Nansen underline that the project has a large number of formal and substantive conditions and reduced procedural guarantees. They conclude that it is not compatible with the obligation to have a fair, effective and accessible procedure for the access of stateless people to their rights.

EMN REG Workshop unveils key strategies for undocumented migrant case resolution

The Return Expert Group (REG) within the EMN conducted a successful workshop dedicated to advancing multistakeholder governance towards case resolution of undocumented migrants. Facilitated by EMN Belgium and the Belgian Federal Agency for the Reception of Asylum Seekers (Fedasil), this event focused on fostering connections between national authorities, local administrations and civil society organisations (CSOs).

Doctors of the world opposes medical examinations under constraint to facilitate the removal of third-country nationals

In a press release published today, Doctors of the World declared that it opposes a new article of the draft law presented by Nicole de Moor, providing for the possibility of carrying out medical examinations under constraint to facilitate the forced return of third-country nationals. Doctors of the World says this measure risks further complicating access to health care for these particularly vulnerable people.

The draft law for a proactive return policy is presented in the House of Representatives

Nicole de Moor presented today a draft law which aims, in accordance with the federal government agreement, to enshrine in law a proactive return policy. The draft law inter alia provides for the obligation to cooperate in the return procedure and for the intensive individual follow up of third-country nationals who have received an order to leave the territory.

Return Directive applies to all irregularly staying third-country nationals, ECJ rules

In its judgment in Case C-143/22 | ADDE and Others, the Court of Justice of the European Union ruled today that the Return Directive applies to any third-country national who has entered the territory of a Member State without fulfilling the conditions of entry, stay or residence. That also applies when the person concerned has entered that territory even before crossing a border crossing point where such checks are carried out.

The General Court of the EU states that Frontex can't be held liable for any damage related to the return of Syrian refugees to Turkey

In its judgment in Case T-600/21 | WS and Others v Frontex, the General Court dismissed today the action of a number of Syrian refugees who had brought a claim for compensation before the General Court of the European Union. The applicants claimed that Frontex engaged in improper conduct with regard to them.

Ad Hoc Query on return decisions and entry bans

The Swedish government has established a committee to review aspects of Swedish legislation concerning the return procedures for third-country nationals. The committee's goal is to propose new measures and revisions to existing laws to enhance the effectiveness of the return process. Deadline for responding to the call for proposals for a framework partnership agreement for post-arrival and post-return assistance

Frontex is launching a new open call for proposals aimed at concluding new framework partnership agreements to provide post-arrival and post-return assistance in 39 countries of origin, with qualified service providers from the non-profit sector, international organisations and national authorities from EU Member States and Schengen Associated Countries for a period of two and a half years.

Ad Hoc Query on drugs in detention centres

At the beginning of 2023, a coordination meeting of the directors of the Belgian closed detention centers was held. At this meeting, they expressed their concern about the significant increase in the trafficking of drugs inside their centers. State Secretary for Asylum and Migration, Nicole de Moor: “Number of voluntary returns exceeds pre-corona levels”

Recognising the severity of the measure against the right to liberty and in order to enhance the safeguards for vulnerable persons, Member States rely increasingly on alternatives to detention.
