On 21 January 2011, the Grand Chamber of the European Court of Human Rights (ECtHR) ruled that returning asylum seekers to Greece violates the European Convention of Human Rights (ECHR). The case of M.S.S. vs. Belgium and Greece concerned an Afghan asylum seeker, who fled his country in 2008 to apply for asylum in Europe. He entered the European Union via Greece and travelled further to Belgium, which returned him in June 2009 according to the Dublin-II convention to Greece. The Court judged that M.S.S. was exposed in Greece to inhuman and degrading treatment (in violation of Art. 3 of the ECHR), and that his right to effective remedies (Art. 13 of the ECHR) was violated.
