ENOC 2025 Seminar: Guardianship and quality of care for asylum-seeking children in the context of the EU Pact on Migration and Asylum

EMN Belgium participates in the ENOC Spring Seminar on the rights of asylum-seeking children

On 27 May 2025, the Belgian Contact Point to the European Migration Network (EMN) participated in a capacity-building session on guardianship and the quality of care for asylum-seeking children in the context of the EU Pact on Migration and Asylum. The seminar was organised by the European Network of Ombudspersons for Children (ENOC), in collaboration with OKaJu (Ombudsman for Children in Luxembourg – Ombudsman fir Kanner a Jugendlecher) and the Luxembourgish Contact Point to the EMN. The aim of the session was to discuss the impact of the new Pact on children in asylum procedures.

Experts explore ways to advance effective alternatives to detention in the EU

On 21 and 22 May 2025, the European Migration Network’s Return Experts Group (EMN REG) convened a two-day workshop, hosted by the Belgian Immigration Office and EMN Belgium. The event brought together 50 participants from EU Member States, EU agencies (including Frontex and the EU Asylum Agency), civil society organisations, and international organisations. The workshop focused on the development and implementation of effective alternatives to detention (ATDs) within the EU’s migration and return systems.

Prisme calls for more inclusive reception and asylum procedures for LGBTQIA+ applicants in Belgium

On 17 May, the International Day Against Homophobia, Biphobia and Transphobia (IDAHOBIT), the organisation Prisme has disclosed a set of recommendations highlighting the challenges faced by LGBTQIA+ individuals seeking international protection in Belgium. These findings point to several shortcomings in the reception and asylum system and outline measures to ensure more inclusive procedures.

Belgium plays key role in joint operation against international migrant smuggling network

On 13 May 2025, Belgian authorities arrested six individuals in West Flanders as part of a coordinated international operation targeting an organised migrant smuggling network suspected of facilitating the irregular entry of up to 300 non-EU nationals into the European Union. In total, fifteen suspects were apprehended in Belgium, Germany and Poland, in a series of actions supported by Europol and Eurojust and involving close cooperation between law enforcement and judicial authorities in the participating countries.

The fourth suspect in the Essex lorry tragedy is sentenced to 12 years in prison by the Bruges criminal court

On 7 May 2025, the Court of First Instance of West Flanders, Bruges division, sentenced the Vietnamese national, N. Van Kim (34), in absentia to twelve years’ imprisonment and a fine of €616,000 for human smuggling under aggravating circumstances. The court also ordered the deprivation of his civil rights for ten years and issued a warrant for his immediate arrest.

Samusocial opens new shelter for unaccompanied foreign minors living on the streets

9.777 people were recorded as homeless in the Brussels-Capital Region in November 2024, according to Bruss’help

This data comes from Bruss’help’s eighth count, carried out through a large-scale collaboration across sectors and indicating a worsening trend of homelessness in Brussels. For the first time, data from reception centres for applicants for international protection were collected. Out of 5.135 individuals, 17 were required to leave their centre within 30 days without any housing solution, while 94 remained beyond their expected departure due to the lack of stable housing options.

Ad Hoc Query on access to education for migrant children

The Belgian Federal Police contributes to an international operation against a major child sexual exploitation platform

An unprecedented international law enforcement operation has led to the dismantling of Kidflix, one of the world’s largest child sexual exploitation platforms. With the support of Europol, authorities from over 35 countries – including Belgium – coordinated efforts to shut down the site and identify the perpetrators. The platform had nearly two million registered users and facilitated the distribution of vast amounts of child sexual abuse material (CSAM).

Belgium, Germany and Italy join forces in Europol operation, resulting in multiple arrests for migrant smuggling across the English Channel

Several raids were carried out on 19 March 2025 by German authorities, with the support of investigators from the Belgian Federal Police. The operation targeted a criminal network based in Germany, facilitating the crossing of the English Channel by small boats. It resulted in 6 arrests under Belgian judicial orders.

EU Parliament study suggests exempting humanitarian assistance and actions aligned with international protection from criminalisation

In a recent study, the European Parliament Research Service (EPRS) recommended clarifying the scope of criminal offences in the Facilitation Directive to ensure that only activities involving organised criminal networks are included and called for the explicit exemption of humanitarian actions aligned with international protection from criminalisation.

ECHR condemns Belgium for failing to provide sufficient safeguards in age assessment of foreign national

The European Court of Human Rights ruled in the case of F.B. v. Belgium, finding that Belgium failed to provide sufficient procedural safeguards in the decision-making process regarding the applicant’s age assessment. The Court concluded that this process violated her right to respect for private life under Article 8 of the European Convention. In particular, it highlighted the lack of informed consent and the failure to explore less intrusive methods before conducting medical tests.

Deadline to apply to be part of the EU Civil Society Platform against trafficking in human beings

The European Commission has launched a call of expression of interest to renew the composition of the “EU Civil Society Platform against trafficking in human beings”. Civil society organisations that are legally based in EU Member States and have demonstrated experience in the protection of and assistance to victims of trafficking in human beings are invited to apply before 5 March 2025.

Belgium contributes to Europol operation against human trafficking networks using online platforms to enable their criminal activities

In a coordinated effort to combat human trafficking, Europol hosted an international operational action from 25 to 28 February 2025, bringing together experts in analysis, OSINT (Open Source Intelligence), and investigations from 12 countries, including Belgium. The operation focused on detecting and disrupting human trafficking networks operating online, particularly those exploiting Ukrainian nationals.

70% of all transmigrants found in Belgium in 2024 were found in West Flanders

According to a report commissioned by the governor of West Flanders, a total of 632 transmigrants were caught in the province in 2024, while in 2023 there were fewer than 400. The province's share of interceptions also went up. West Flanders accounted for about 70% of all transit migrants intercepted in Belgium in 2024, compared to around 50% in previous years.

The share of non-EU nationals among trafficking victims in the EU is increasing, according to the EU Commission

The European Commission published its fifth report on the progress made in the EU in combatting Trafficking in Human Beings. The report outlines, inter alia, that in 2021-2022, the majority of victims were non-EU citizens (54%). This demonstrates a shift compared to 2019-2020, when the majority of registered victims were EU citizens (55%).

Brussels activates Extreme Cold Plan to protect the homeless from the extreme winter cold

As of 7 January 2025, 160 additional emergency shelter places are made available for homeless people sleeping on the streets in the Brussels Capital Region, supplementing the existing 2.600 places within the Brussels unhoused shelter network. The emergency shelter places are open to all homeless people, regardless of residence status.

Annual Report on Trafficking and Smuggling in Human Beings 2024 (Myria)

Myria, the Federal Migration Centre and independent national rapporteur on trafficking in human beings, published its independent and public annual report "Latin American Sex Work: A Risky Carousel" on 18 December 2024. Myria draws attention to the phenomenon of Latin American sex work and calls for adapting the fight against trafficking to the new realities linked to the digital world.

Member States agree a position on a proposed directive which lays down minimum rules to prevent and counter migrant smuggling

During the Justice and Home Affairs Council on 13 December 2024, Member States agreed on a proposal aimed at bringing their criminal law closer together on issues such as the definition and sanctioning of migrant smuggling. The text will now be used by the Council in “trilogue” negotiations with the European Parliament.

Belgium and its Calais Group partners agree on a priority plan to counter migrant smuggling

In London, the UK, Germany, France, Netherlands and Belgium, in the presence of the European Commission and its agencies, Europol and Frontex, agreed on a five-point priority plan to tackle irregular migration and migrant smuggling in 2025. Key priorities include targeting illicit financial flows that sustain smuggling networks and tackling organised crime groups' use of social media to recruit and advertise dangerous journeys across Europe and the Channel.
