Ad-Hoc Query on organisation and management of legal assistance provided to foreigners in the EU Member States

This Ad Hoc Query has taken place in 16 European Member States. It gives an overview of the organisation and management of legal assistance provided by Member States and NGOs to foreigners.

The Ad Hoc Query gives a comparative overview of the legal assistance provided to foreigners in 16 European Member States. The initiative of this Ad Hoc Query was initated by the Polish National Contact Point of the European Migration Network (EMN).

Legal assistance to foreigners with low-income is provided in every European Member States. However, the degree of complexcity and the fact that these assistances are provided by States or by NGOs varies, depending on the State.

Each country gives a description of how legal assistance is applied on their terrritory. They also explain the procedures foreigners have to follow in order to benefit from such services.

The different Member States also explain how the art.15 and art.16 of the Directive 2005/85/EC and art. 13 point 3-4 of the Directive 2008/115/EC, which regulate access to legal advice, have been implemented in their national laws.
