Ad Hoc Query on granting a residence permit on the basis of a child protection order

In the Netherlands, there is a special policy applicable to third-country national children based on a family supervision order (child protection order) that is imposed by the juvenile court. The Dutch authorities launched this query because they want to know whether it is possible for a minor third-country national who is covered by a similar order to receive a residence permit in other Member States.

Ad Hoc Query on guardianship of unaccompanied minors

The Luxembourg Ombudsman for Children and Youth (OKaJu), together with UNICEF Luxembourg, is carrying out research on the situation of unaccompanied minors (UAMs) in Luxembourg. In this context, they would like to collect information on good practices in other EU Member States with a focus on the guardianship of UAMs.

The updated list of safe countries of origin is published in Belgium’s Official Journal

The list of safe countries of origin, which is revised once a year, was updated on 7 April 2023 and is now published in Belgium’s Official Journal. At present, the following countries are considered as safe countries of origin: Albania, Bosnia and Herzegovina, the Republic of North Macedonia, Kosovo, Montenegro, Serbia, and India.

The Court of Justice clarifies the conditions for revoking or refusing refugee status

In its judgments in cases C-8/22, C-663/21 and C-402/22, the Court clarified the conditions for revoking or refusing refugee status with regard to a third-country national who is convicted of a crime. The individual concerned must, inter alia, constitute a genuine, present and sufficiently serious threat to one of the fundamental interests of society and the decision must observe the principle of proportionality.

Ad Hoc Queries on residence procedure specifically for unaccompanied minors

The Belgian authorities are looking to improve/review the special residence procedure for unaccompanied foreign minors, known as the Best Interest Procedure. In this context, Belgium launched three ad hoc queries to seek information from other Member States on (i) similar residence procedures specifically for UAMs, (ii) procedures followed in case return to the country of origin is considered and (iii) steps taken to implement return decisions.

Ad Hoc Query on time limit to reopen an application in the event of implicit withdrawal or abandonment of the application according to the directive 2013/32/EU

In the event of implicit withdrawal or abandonment of an asylum application, Art. 28 par. 2 of the directive 2013/32/EU allows Member States to determine in their legislation a time limit of at least nine months, after which the applicant’s case can no longer be reopened or the new application may be treated as a subsequent application. The German Federal Office for Migration and Refugees launched an ad hoc query to enquire whether and how the Member States transposed this provision.

Global Displacement Forecast 2023 (Danish Refugee Council)

The DRC Global Displacement Forecast 2023 Report, projects that the total number of people displaced will increase by 1.9 million in 2023 and an additional 3.5 million in 2024. This means that by 2024, the number of displaced people will have more than doubled since 2015 and increased by more than 50 million.
