UNHCR and NANSEN Study day on statelessness

On the occasion of the 70th anniversary of the International Convention relating to the Status of Stateless Persons, UNHCR and NANSEN organise a study day on statelessness. Particular emphasis will be placed on the rights of stateless persons and the specific procedures applicable in Belgium, in particular the new residence procedure for stateless persons.

Many people may not have access to the new residence procedure for stateless persons in Belgium, according to Myria

Myria has published the fifth thematic section of its 2024 annual report. In this section, entitled « International protection », Myria pays particular attention inter alia to the new residence procedure for stateless persons. The Federal Migration Centre underlines that the new procedure is subject to strict conditions and that it provides reduced procedural guarantees for stateless persons.

The Convention relating to the Status of Stateless Persons celebrates its 70th anniversary

As the 1954 Convention relating to the Status of Stateless Persons celebrates its 70th anniversary on 28 September 2024, the United Nations High Commissioner for Refugees (UNHCR) estimates the number of stateless people worldwide at more than 4 million by the end of 2023.

Refugee students start a master's degree at the KU Leuven and UCL Louvain as part of the EU Passworld programme

Stateless persons in Belgium can now apply for a residence permit from the Immigration Office

The law of 10 March 2024 which creates a residence status as a stateless person in Belgium, comes into force on 1 September 2024. Applications for admission to stay on the grounds of statelessness must now be submitted directly to the Immigration Office by registered mail.

The Court of Justice of the EU stresses that the prohibition of abusive practices is a general principle of EU law

In a judgement from 29 July 2024, the Court of Justice of the EU states that a Member State may reject an abusive application for an authorisation to reside on its territory for the purpose of study, even if it has not correctly transposed the directive that provides for that option.

Ad Hoc Query on intra-EU mobility for international students (Directive 2016/801)

This ad hoc query focuses on the implementation of Article 31(2) of Directive 2016/801, which sets out the conditions for notifying mobility of students between two or more EU Member States. The query examines the mobility notification process, existing arrangements in the absence of an official notification process, and the rules applicable to students covered by an EU programme, a multilateral programme involving mobility measures or an agreement between two or more higher education institutions, as opposed to those applicable to students who are not.

Joint EMN Luxembourg and Council of Europe meeting: Statelessness and children

This multistakeholder meeting, jointly organized by the Council of Europe and the EMN Luxembourg within the framework of the EMN Platform on Statelessness, will allow participants to share good practices and challenges on topics including the age assessment and best interest of the child; the burden of proof in the special case of children and the access to nationality for children.
