Influence of the European Sources on the Belgian Asylum Law: from the texts to the decisions

The Catholic University of Louvain will organize a restricted seminar about the first findings of a research project concerning the implementation into the Belgian law of the Dublin Regulation and the Qualification Directive

This research project relates to the transposition and the application of the European law and of the European Convention on human rights, major stakes as regards asylum.

The legal framework as well national (with the integration of the “Dublin II” regulation and the transposition of the “Qualication” Directive) as European, with the study of the texts and jurisprudences of the EU and the CEDH, has been synthesized, by underlining the discordances.

A collection of the Belgian jurisprudence as regards “Qualication” and “Dublin cases” has been carried out.

The second stage will relate to the analysis of the coherence of Belgian jurisprudence, taking into consideration European requirement. A jurisprudential database as of tools for the analysis of this one will be put on line.

This seminar aims at sharing the first results of this research. The number of participants, all experts of the asylum law, has been voluntarily limited. A public conference will be organized in May 2012.
