Administrative fine is due when carrying someone (even if later authorized) to Belgium without necessary documents

The Court of Cassation ruled today that an administrative fine is due for carrying someone who doesn't hold documents to enter or transit Belgium, even if at the border an authorization to enter is issued.

The Court of Cassation ruled on 9 May 2014 that a penalty can be imposed when a passenger is carried to Belgium without holding the documents required to stay there or to transit to another third country, even if an authorization is issued to him/her upon arrival.

The Court of Appeal had previously considered that the fine wasn’t due when, at the border, the foreigner without the documents required to enter, was authorized to enter the territory.
